It is with great pleasure and relief that we can announce that all J-1 visa programs have resumed! The injunction allowing J-1 programs to resume was successful. All J-1 program categories, including J-1 Intern, Trainee, Teacher, Work/Travel, Australia/New Zealand, etc., are back in business!

Please therefore immediately proceed to continue your application process with CICD and your visa application with your local US Embassy/Consulate for your programs starting this year or in 2021. If you have already received a DS-2019 form for 2021 and you and your host company would like to change your start date to 2020, please let us know right away.

We recently received confirmation that the preliminary injunction against President Trump’s June 22nd proclamation was approved, meaning the President’s proclamation suspending the J-1 programs is void and unenforceable until a trial can take place. Considering a trial would take several months and the President’s proclamation was set to expire on December 31, 2021, it is assumed that the injunction will last until the proclamation is set to expire and a trial will not be necessary.

This is excellent news for the Exchange Visitor community and our respective companies since there are no longer formal restrictions against the participation in the J-1 program. This means that Ody**** may resume issuing DS-2019 forms for eligible candidates with start dates any time in the future, including start dates in these final months of 2020. Embassies around the world should also begin issuing new J-1 visas, assuming they have resumed normal visa processing.

This is the first important step towards reviving the exchange industry and Ody**** is eager to begin working with you to sponsor as many exchange visitors as possible for start dates this year and in to 2021. Please let me know the outlook for the remainder of your year so we can work together on addressing any remaining challenges and issuing DS-2019 forms as quickly as possible.

I wanted to reach out to you regarding a major update that just came through a few hours ago. This afternoon, a federal judge partially blocked the June 22, 2020 proclamation, stating it is illegal.

Based on the suit, an injunction has been approved, meaning the consulates and embassies should begin starting processes for J-1 visas. This window may be limited if there is an appeal. As a result, we need to get started urgently to process any cases that are interested in starting this year. If the government appeals, we cannot confirm if processes will halt again. Thus the urgency. 

If you would like to hop on a call, please let me know. I just received this news and will be on webinars and calls to break this news down further and what to expect next. I'll send you a list of EVs we have actively paused, which we will need confirmation on if they are pursuing their programs.
